Issue Paper on the Strike Ban

This research determines the viability and non-viability of having a strike ban as a policy option.  It presents a thorough analysis of the legal implications of imposing a strike ban, and tries to address the issue concerning the alleged negative effects of strikes on the economy and investors.

Instead of a legislated strike ban, the paper recommends the following: (1) voluntary agreements for a moratorium for a strike/ lockout between labor union and management decided at the shop-floor, local government unit (LGU), or federation levels; (2) voluntary agreement at the shop-floor level on a moratorium on increases in the economic demands in the collective bargaining agreement; and (3) limit government’s role to facilitation rather than intervention, and providing incentives and support services.
