Labor Policies in Foreign Workers in the Philippines

The Philippines is currently reviewing the possibility of relaxing domestic labor market rigidities by liberalizing the procedures, requirements, fees and periods of validity regarding the employment of foreign nationals from ASEAN-member countries, as part of its initial commitment under the General Agreement on Trade in Services (GATS).

The paper provides a brief discussion on specific provisions of laws governing the hiring of foreign nationals in local industries, professions with reciprocity provisions, rights to self-organization, and regulations on the entry of alien employees, among others.

The country’s policies on foreign workers are found mainly in the 1987 Constitution; the Labor Code of the Philippines, other related laws and statutes; as well as international covenants entered into by the Philippines.
