Issue Paper on the Strike Ban

Economic downturns and crises, among others, are some of the social phenomena that trigger the restiveness of the labor sector.  Allegations of the ill effects of strikes to the national economy cause the public to debate on its propriety.

The controversy factor attached to the issue has brought forth serious debate between the labor sector, on one side, and management, on the other.  The absence of studies concerning the relationship between strikes and the national economy, likewise, makes the issue more difficult to resolve.

This paper seeks to determine the viability and non-viability of having a strike ban as a policy option.  It strives to present a thorough analysis of the legal implications of imposing a strike ban, and tries to confront the issue concerning the alleged negative effects of strikes on the economy and investors’ confidence.
